Public Offer Agreement

For the Provision of a Tandem Paragliding Flight with an Instructor in Ölüdeniz, Turkey
This Agreement constitutes an official and public offer of the Service Provider to enter into an agreement for the provision of a tandem paragliding flight with an instructor (the “Service”), as presented by Fly Infinity Paragliding on the website https://flyinfinityparagliding.com.
This Agreement is a public agreement, meaning that, in accordance with Article 633 of the Turkish Civil Code, its terms are identical for all Customers and do not grant preference to one Customer over another.
By entering into this Agreement, the Customer confirms full acceptance of its terms and conditions, including the procedures for booking, payment, cancellation, rescheduling, and compliance with safety rules.
This Agreement shall be deemed concluded at the moment the booking is confirmed (including verbal, written, or electronic confirmation) and the deposit in the amount specified on the website or agreed with the Service Provider is paid.

1. Definitions1.1. Public Offer — a public proposal made by the Service Provider and addressed to an indefinite number of persons to conclude a paid service agreement for a tandem paragliding flight with an instructor.
1.2. Service — a tandem paragliding flight with an instructor selected by the Customer on the Service Provider’s website or ordered through other available communication channels.
1.3. Service Provider’s Website — https://flyinfinityparagliding.com.
1.4. Customer — a legally capable individual who has reached the age of 18 (or minors with parental consent), or a legal entity that has placed an order for the Service and accepted the terms of this Agreement.
1.5. Service Provider — Fly Infinity Paragliding, an organization operating in accordance with the laws of the Republic of Turkey and providing tandem paragliding flight services in Ölüdeniz in compliance with international safety and certification standards.

2. Subject of the Agreement2.1. The Service Provider undertakes to provide the Customer with a tandem paragliding flight with an instructor, and the Customer undertakes to pay for the Service under the terms and conditions of this Agreement.

3. Booking, Payment, and Prices3.1. Booking of the Service may be made via the website, messengers, the Service Provider’s office, or other available communication channels.
3.2. To confirm a booking, the Customer shall pay a deposit in the amount specified on the website or agreed with the Service Provider.
3.3. The remaining balance shall be paid on the day the Service is provided, in cash at the office prior to the flight, or by another method agreed upon by the parties.
3.4. Prices for the Services are determined independently by the Service Provider and may be changed unilaterally without prior notice to the Customer, depending on market conditions. The price of a Service fully paid by the Customer prior to such changes shall not be subject to revision.

4. Cancellation and Rescheduling Policy4.1. In the event the Customer cancels the booking less than 24 hours before the scheduled flight, the paid deposit shall not be refunded and shall be deemed compensation for the reservation of the Service Provider’s time and resources.
4.2. If the flight cannot be conducted due to reasons beyond the Service Provider’s control (including adverse weather conditions, closure of flight zones, or force majeure), the flight shall be rescheduled to another date by mutual agreement of the parties.
4.3. If the Customer is unable to reschedule the flight to another date, the deposit shall not be refunded.

5. Rights and Obligations of the Parties The Service Provider shall:provide the Service on the agreed date and time, subject to safe weather conditions; provide a qualified instructor and the necessary equipment; inform the Customer of applicable safety rules and procedures. The Customer shall: arrive at the designated place at the specified time; follow all instructions given by the instructor; inform the Service Provider of any medical conditions or contraindications that may affect participation in the flight.

6. Liability
6.1. The Service Provider shall not be liable for the inability to provide the Service due to reasons attributable to the Customer, including late arrival, failure to appear, or refusal to participate in the flight on site.
6.2. The Customer shall be responsible for complying with safety rules and following the instructor’s instructions.

7. Miscellaneous
7.1. All disputes arising out of or in connection with this Agreement shall be resolved through negotiations; failing such resolution, they shall be submitted to the courts of the Republic of Turkey.
7.2. This Agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey.
7.3. The Service Provider reserves the right to amend this public offer without prior notice by publishing a new version on the website.
